I think there is some confusion on this issue. Paul and Nicolas made
it extremely and very vocally clear that they not only do not intend
to make Newton ROMs publicly available, they will also not assist in
any way on methods to get the ROMs.
As to the matter of opensourcing the layer of software on top of the
ROM, the JIT or the HAL (or whatever it may eventually be called),
nothing has been promised about that. But since it's their baby, they
can pretty much do with it whatever they want.
