If he doesn't specifically disclaim in the auction listing that the
software is also available for free, he is either unaware of this or
is trying to deliberately scam people.

You should first send him a message about the situation, and if he
doesn't reply or gives a non-denial denial, you can get in touch with
eBay about him and file a report against him.
