I would think it is ESD and I observed a similar thing. THe spark goes from
your finger to the pen and then somewhere inside to a metallic part,
possibly the mobo of the Newton and causes switching on. However, the Newton
should withstand that w/o problems because in the ESD test which is required
for the CE sign, the body of the device has to be "bombarded" with ESD
sparks.
