No, Palm, Inc. does control the Pre.

Looks like I was out-of-date. Palm, Inc. (formerly PalmOne, the Palm
hardware company) bought the rights to the Garnet Palm OS from Access
(who had taken over PalmSource, the Palm software company) in Dec 2006.
