No, it's *trademarks* that need to be defended. Copyright does not.
Think about it - there are tons of books and other copyrighted material
that is out of print because nobody can find the copyright holder, and
therefore can't get permission to publish it. If either of you were
correct, a publisher would just have to show a "good faith" effort to
find the copyright holder before publishing it on their own.
