So the core issue is whether the "give me your name and e-mail" thing is an
adequate control. And, to be honest, if it were me, I'd add another layer
yet to the site... Use the given e-mail addy, send a mail that requests a
reply, and upon receipt of the reply, send an e-mail with the actual
download URL (and have the site turn back a request from other than the
original IP, even though that may pose possible problems for dial-in folks
who have a different IP everytime.). Or some variation on this.
Of course, this doesn't prevent a person from being dishonest, but it does
provide a verified trail to each and every downloader, should the copyright
holder choose to contact individual downloaders.
The TRUE bottom line, though, is that the average person often mistakes the
LEGAL system for a JUSTICE system. We may have disparate views, but it's
plain that we're all trying to be conscientious and do what's right, fair,
and just. Unfortunately, those concepts are completely alien to the LEGAL
system.
